Scooter's Surprise Giveaway Sweepstakes
NO PURCHASE NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. THIS SWEEPSTAKES IS VOID WHERE PROHIBITED BY LAW.
Eligibility:
Sweepstakes participants must be a U.S. resident and at least 18 years of age at the time the sweepstakes begins and who have valid Facebook/Twitter/Instagram/social media accounts. The Scooter’s Coffee, Scooter's Surprise Giveaway, Sweepstakes (“Sweepstakes”) is void outside the United States, or where prohibited or restricted by law.
This Sweepstakes is sponsored by Scooter's Coffee LLC (“Sponsor”). All employees, officers, directors and agents and their immediate families or any members of their households, regardless of relationship, of Sponsor or any advertising agency or other company involved with the design, production, execution, or distribution of this Sweepstakes are not eligible to participate in the Sweepstakes or to win any prizes. The Sweepstakes are in no way sponsored, endorsed, or administered by, or associated with Facebook/Twitter. You understand that you are providing your information to Sponsor and not to Facebook/Twitter. The information you provide will only be used in the event you are selected as the Sweepstakes winner.
Any Sweepstakes entries received from an ineligible participant will be disqualified. By participating in this Sweepstakes, participants accept and agree to be bound by these rules and the decisions of Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the rules of the Sweepstakes in any way at any time, subject to state or federal law.
Sweepstakes Period:
The Sweepstakes begins on 12/21/2020 and 12:00am CST and ends on 1/1/2021 and 11:59pm CST (“Sweepstakes Period”). All entries must be received and recorded by Sponsor during the Sweepstakes Period to be eligible.
How To Enter:
You can enter the Sweepstakes through commenting on Sponsor’s Facebook at https://www.facebook.com/ScootersCoffee and submitting your name, phone number, and email address to Sponsor via private message on Facebook, by retweeting or commenting on Sponsor’s Twitter at https://twitter.com/scooterscoffee and submitting your name, phone number, and email address to Sponsor via private message on Twitter, or by commenting on Sponsor’s Instagram at https://www.instagram.com/scooterscoffee/ and submitting your name, phone number, and email address to Sponsor via private message on Instagram. One entry per person permitted. Duplicate entries will be rejected for entry in the Sweepstakes.
Sponsor is not responsible for lost, misdirected, late, unsent, incomplete, illegible, or unintelligible entries or for inaccurate entry information, whether caused by the participant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical or human error that may occur in the transmittal of any entry or the processing of any function on the participant’s computer system. Participant must notify Sponsor of any changed contact information within the Sweepstakes Period to remain eligible to win based on entry information. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these rules; or to be acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed, or similar response methods will void all such entries submitted by such methods.
Prizes and Selection of Winners:
Sweepstakes participants will enter for a chance to win $10 gift card (redeemable at any location), exclusive pair of limited-edition socks, a 12oz bag of our best-selling Scooter Doodle Coffee, a Scooter's branded Love mug, and a featured call-out on Scooter's coffee email and social media channels. The chances of winning depend on the number of entries received. No transfer, assignment, cash redemption, store credit redemption or substitution of any prize is permitted, except by Sponsor due to prize availability and then with a prize of equal or greater value.
Winners will be selected in a random drawing on 1/4/2021. Sponsor will notify each winner individually by email or social media message.
Winners must respond within ten (10) business days of being notified or the prize may be forfeited, and another Sweepstakes participant chosen. Each winner must satisfactorily complete an affidavit of eligibility showing compliance with these Sweepstakes Rules, and each winner must also sign a liability and publicity release, allowing Sponsor to use his or her information for advertising or other purposes. Failure to complete these forms may result in forfeiture of the prize. In the event that the potential winner is disqualified for any reason, Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries. Potential winners consent to the use of their entry, name, voice, photograph, and other likeness by Sponsor for public relations, advertising, and promotional purposes in perpetuity, worldwide, in any and all media, without further compensation or notification, unless prohibited by law.
Winners are solely responsible for all applicable federal, state, or provincial, and local taxes and any expenses associated with any prizes. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for each recipient who received a prize/award if the annual aggregate is at least $600 or more. The total approximate retail value of the prize to be awarded in this Sweepstakes is $25 (USD). In the event the approximate retail value is deemed to exceed the Internal Revenue Service requirement, winners who are residents of the United States of America must complete and submit a W-9 form to receive any prize. The recipient is responsible for any income tax liability and should consult his/her tax advisor for the proper tax treatment of this income on his/her tax return.
Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend this Sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or impair the administration, security or fairness of the Sweepstakes. Sponsor is not responsible for any human or technological error that may occur in the processing of the Sweepstakes nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this Sweepstakes, or otherwise.
Limitation of Liability and Dispute Resolution:
Participants hereby release Facebook/Twitter, Sponsor, and Sponsor’s franchisees, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors, from any liability related to any claim of injury, damage, loss or liability to person or property, due in whole or part, directly or indirectly, to the acceptance, possession, use or misuse of any prize or participation in this Sweepstakes. Once the prize has been distributed, participants understand that there can be no claims for liability made against the above-named parties.
Except where prohibited, each participant and winner accepting a prize agrees that: (a) all issues and questions concerning these rules shall be governed by Nebraska law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Nebraska, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys' fees; and (d) under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
