Frisco Bowl Mystery Drink Sweepstakes

OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

  1. Sponsor: Scooter’s Coffee, LLC is the sponsor (“Sponsor”) of the Scooter’s Coffee Frisco Bowl Mystery Drink Sweepstakes (the “Sweepstakes”).
  2. Eligibility: This Sweepstakes is open only to persons in the contiguous United States and the District of Columbia (excluding residents of Hawaii, Alaska and Rhode Island) who are the age of majority in their state of residence as of November 18, 2024. Notwithstanding the foregoing, any employees, independent contractors, interns, officers, directors, and agents of Sponsor or any of Sponsor’s affiliates, subsidiaries, advertising and promotion agencies, and suppliers (and any family or household members of such individuals) are not eligible to participate in this Sweepstakes. Each individual who is eligible to participate in this Sweepstakes shall be referred to in these Official Rules as a “Participant”. This Sweepstakes is subject to all applicable laws and regulations, and is void where prohibited.
  3. Agreement to Rules: By entering this Sweepstakes, Participant agrees to comply with and abide by these Official Rules and the decisions of Sponsor, and represents and warrants that Participant meets the eligibility requirements. In addition, Participant agrees to accept Sponsor’s decisions as final and binding as it relates to the content of this Sweepstakes and these Official Rules.
  4. Entry Period: This Sweepstakes begins on November 18, 2024 at 12:00AM CDT and ends on December 1, 2024 at 11:59PM CDT (the “Entry Period”).
  5. How to Enter: During the Entry Period, Participant may enter this Sweepstakes by the method described below:
    • (a) Online Entries. Participant may submit one entry per valid email to this Sweepstakes as permitted by:
      1. Navigating to the Frisco Bowl Mystery Drink URL: www.scooterscoffee.com/whatsinthecup
      2. Submitting a correct guess for the mystery ingredient; and
      3. Providing your name and a valid email for contact (which will be used solely for sweepstakes participation
    • Multiple entries from one email address will be not accepted. In order to qualify as the Grand Prize Winner, Participant must be willing and available to travel to Frisco, TX for the December 17, 2024 Scooter’s Coffee Frisco Bowl and participate in the game coin toss.
  6. Prizes: One (1) Grand Prize Winner of this Sweepstakes (“Grand Prize Winner”) will be randomly selected, as further described below, to receive as follows:
    • A trip for two (2) to Frisco, TX for the Scooter’s Coffee Frisco Bowl to assist in administering the bowl game coin toss. The trip includes:
      • An airline travel voucher of up to $1,400.
      • Hotel accommodations at the Omni Hotel in Frisco, TX from 12/16/2024 through 12/18/2024.
      • Two premium (2) tickets to the Frisco Bowl (may include endzone, 50 yard line or suite seats, as determined by availability).
      • Access to the Scooter’s Coffee Star Event private tour pre-game.
      • Two (2) Scooter’s Coffee branded suitcases.
      • Pre-Game On-field access.
      • Participation in the Frisco Bowl official coin toss.
      • Opportunity to be on the field for the post-game trophy presentation.
    • Two (2) Secondary Prize Winners (“Secondary Winners”) will also be randomly selected, as further described below, to each receive as follows:
      • Scooter’s Coffee Frisco Bowl branded merchandise.
      • Scooter’s Coffee gift card of $100.
    • Prizes consist of only those items specifically listed as part of each prize. No cash equivalent or other prize substitution will be permitted except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded and are non-transferable by any Grand Prize or Secondary Prize Winner (collectively, each a “Winner”). If a potential Winner is disqualified for any reason, Sponsor may award the applicable prize to an alternative Winner by random drawing from among all remaining eligible entries or from the Secondary Prize Winners (as applicable). Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of each Winner. Acceptance of a prize constitutes permission for Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
  7. Odds of Winning: The odds of winning this Sweepstakes depends on the number of eligible entries received during the Entry Period.
  8. Winner Selection and Notification: The Winners of this Sweepstakes will be selected by a random drawing on or about December 2, 2024. The potential Winners will be notified within 5 business days of their selection by email or phone. Potential Winners may be required to sign and return a completed affidavit of eligibility and release(s) via fax or email within 24 hours of prize notification, with the original documents sent to Sponsor via overnight mail within two (2) days of the date of prize notification. Non-compliance with these Official Rules, the inability of Sponsor to timely contact a potential Winner, a potential Winner’s failure to claim a prize within 2 business days from the time Sponsor sent the award notification, or a prize’s or prize notification’s return as undeliverable will result in such potential Winner’s disqualification and, at Sponsor’s discretion, Sponsor may award the applicable prize to a potential alternative Winner. Receipt of each prize offered in this Sweepstakes is conditioned upon compliance with all applicable federal, state, and local laws and regulations and these Official Rules. Allow 6-8 weeks from the date declared a Winner for delivery of the prize in its entirety.                                                                                                                                                           

    Sponsor reserves the right to conduct a background check of any and all records of the Grand Prize winner and the Grand Prize winner’s guest and including without limitation, civil and criminal court records, police reports and social media. To the extent necessary under law, Grand Prize winner and their guest shall authorize this background check and acknowledge that Sponsor has a legitimate business need for such background check. Sponsor may also take all steps necessary to corroborate any information provided to Sponsor by Grand Prize winner in his/her interview including conducting its own internal vetting process. In that regard, Grand Prize winner and their guest will be obligated to provide necessary contacts and information (including but not limited to full legal name, home address, telephone number and date of birth) so that Sponsor may conduct such investigation and internal vetting. Sponsor reserves the right (at its sole discretion) to disqualify the Grand Prize winner and their guest from any prize element, based on the background check or internal vetting. Disqualification of the Grand Prize Winner will result in automatic disqualification of his/her guest. Sponsor reserves the right (in its sole discretion) to permit Grand Prize Winner to select a different guest based on the guest’s background check.
  9. Rights Granted by the Entrant: By entering this Sweepstakes and submitting any content (e.g., photo, video, text, etc.), Participant understands and agrees that Sponsor and anyone or entity acting on behalf of Sponsor or its affiliates or its or their respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, Participant’s entry, name, portrait, picture, voice, likeness, image, statements about this Sweepstakes and/or Scooter’s Coffee, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this Sweepstakes, Participant represents and warrants that Participant’s entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If Participant’s entry infringes or is alleged to infringe upon the intellectual property right of another, Participant’s entry will be disqualified at the sole discretion of Sponsor. If the content of Participant’s entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, Participant shall, at Participant’s sole expense, defend or settle against such claims. Participant shall indemnify, defend, and hold harmless Sponsor and Sponsor’s affiliates from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor and Sponsor’s affiliates may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. By entering this Sweepstakes, Participant also agrees to be interviewed and photographed by Sponsor if Participant is randomly selected as a winner of this Sweepstakes and Participant accepts such prize, and that Sponsor may announce on scooterscoffee.com and related websites owned and operated by Sponsor Participant’s full name, photo, likeness, and statements and publish a post with such items to all social media accounts including Facebook, Instagram, Twitter, and any other social media platforms, and any other forms of media.
  10. Terms and Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of this Sweepstakes. In such cases, Sponsor may select Winners from eligible entries received as of the date of such action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any Participant who tampers or attempts to tamper with the entry process or the operation of this Sweepstakes or any website or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of this Sweepstakes and to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses or multiple entries from the same computer in excess of that allowed by the Official Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
  11. Limitation of Liability: By entering this Sweepstakes, Participant agrees to waive all right to, and to release and hold harmless Sponsor, ESPN, Inc. and each of their respective affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, from any liability, illness, injury, death, loss, litigation, claim, damage that may arise out of or in connection with participation in this Sweepstakes or the acceptance, possession, use, or misuse of any prize or any portion thereof, whether caused by negligence or not. In no event will Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, be responsible for: (i) lost, late, incomplete, or incorrect entries; (ii) a Participant's failure to receive prize notices due to the Participant’s spam, junk e-mail, or other security settings or the Participant’s provision of incorrect or otherwise non-functioning contact information; (iii) unauthorized human intervention in any part of this Sweepstakes; (iv) electronic or human error which may occur in the administration of this Sweepstakes or the processing of entries in this Sweepstakes; (v) technical, hardware, or software errors or malfunctions of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; (vi) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vii) any typographical, technological, printing, or other error in the offer or administration of this Sweepstakes or announcement of its prizes; or (viii) lost, late, postage due, misdirected, or undeliverable mail.
  12. Choice of Law and Forum: Participant agrees that all matters arising out of or relating to this Sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of the state of Nebraska, without giving effect to any of its conflict of laws principles. Participant further agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes and these Official Rules, shall be resolved individually, without resort to any form of class action, and exclusively before any applicable federal or state court located in Omaha, Douglas County, Nebraska. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and Participant hereby waives all rights to, punitive, incidental, or consequential damages, including without limitation attorney’s fees, other than actual out-of-pocket expenses (i.e., any costs associated with entering this Sweepstakes), to the extent permitted by law. Participant further waives all rights to have damages multiplied or increased.
  13. Winners List: To request a copy of the Winners list, available after December 5, 2024, please send a self-addressed, stamped envelope to: Frisco Bowl Mystery Drink Sweepstakes, 10500 Sapp Brothers Dr., Omaha, NE 68138. Requests must be sent within four (4) weeks of the end of the Entry Period.
  14. No Sponsorship/Endorsement: This Sweepstakes is in no way sponsored, endorsed, or administered by or associated with Facebook, Twitter, Instagram, or any other social networks that are used to share this Sweepstakes, and Participant completely releases Facebook, Twitter, Instagram, and any such other social networks from any and all claims related to or arising from this Sweepstakes. Participant understands that Participant is providing Participant’s information to Sponsor of this Sweepstakes and not to Facebook, Twitter, Instagram, or any other social network.
  15. Acceptance of Rules: By participating in this Sweepstakes, Participant acknowledges and agrees that Participant has affirmatively reviewed, accepted, and agreed to all of the Official Rules.
