Scooter's Coffee – Luck of the Leprechaun Sweepstakes
OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Sponsor: Scooter’s Coffee, LLC is the sponsor (“Sponsor”) of the Scooter's Coffee – Luck of the Leprechaun Sweepstakes (the “Sweepstakes”).

2. Eligibility: This Sweepstakes is open only to persons who are the age of majority in their state of residence as of March 22, 2024. Notwithstanding the foregoing, Rhode Island and New York residents and employees, independent contractors, interns, officers, directors, owners, and agents of Sponsor, any Scooter’s Coffee franchise store, or any of Sponsor’s affiliates, subsidiaries, advertising and promotion agencies, and suppliers (and any family or household members of such individuals) are not eligible to participate in this Sweepstakes. Each individual who is eligible to participate in this Sweepstakes shall be referred to in these Official Rules as a “Participant”. This Sweepstakes is subject to all applicable laws and regulations, and is void where prohibited.

3. Agreement to Rules: By entering this Sweepstakes, Participant agrees to comply with and abide by these Official Rules and the decisions of Sponsor, and represents and warrants that Participant meets the eligibility requirements. In addition, Participant agrees to accept Sponsor's decisions as final and binding as it relates to the content of this Sweepstakes and these Official Rules.

4. Entry Period: This Sweepstakes begins on March 22, 2024 at 12:00 a.m. CST and ends on March 27, 2024 at 11:59 p.m. CDT (the "Entry Period"). (the "Entry Period").

5. How to Enter: During the Entry Period, Participants may enter this Sweepstakes by only one of the two methods described below (i.e., online entry or mail-in entry).

   1. Online Entry. Participants may enter this Sweepstakes by completing all of the following actions during the Entry Period:

      1. LIKE Scooter’s Coffee’s Instagram post that is dated March 22, 2024 and announces this Sweepstakes;

      2. FOLLOW @Scooterscoffee on Instagram;

      3. TAG a friend; and

      4. submit a completed electronic form (with Participant’s full name, email address and mailing address) when prompted to do so.

      A Participant’s timely completion of all of the above actions will result in one entry into this Sweepstakes.

      After timely completing all of the above actions, Participant may receive an additional entry into this Sweepstakes for each additional individual the Participant tags during the Entry Period; provided that the maximum total number of entries that a Participant may submit to this Sweepstakes via the online entry method is twenty (20) entries.

   2. Alternative Means of Entry (Mail-In Entry). A Participant may alternatively enter this Sweepstakes, without having to complete any of the above online methods and electronically submitting the above referenced electronic form, via U.S. Mail, by printing Participant’s name, address, city, state, zip code, and daytime and evening phone numbers (including area code) on a 3” x 5” card (each such completed card, a “Postcard”), and mailing that Postcard during the Entry Period to: Scooter's Coffee – Luck of the Leprechaun Sweepstakes, 11808 Miracle Hills Dr., Ste. 400, Omaha, NE 68154.

      A Participant’s timely submission of a Postcard to Sponsor will result in one entry into this Sweepstakes.

      A Participant may receive an additional entry into this Sweepstakes for each additional Postcard that Participant submits to Sponsor during the Entry Period; provided that the maximum total number of entries that a Participant may submit to this Sweepstakes via the mail-in entry method is twenty (20) entries.

   3. Online entries submitted or mail-in entries postmarked before or after the Entry Period will not be eligible for entry in this Sweepstakes.

   4. The entry must fulfill all requirements of this Sweepstakes, as specified in these Official Rules, to be eligible to win a prize (as described below). Entries that are incomplete or do not comply with these Official Rules may be disqualified at the sole discretion of Sponsor. Participant must provide the information requested. Participant may not enter this Sweepstakes more than one time per method described above by using multiple email addresses, identities, or devices in an attempt to circumvent these Official Rules. If Participant uses fraudulent methods or otherwise attempts to circumvent these Official Rules, Participant’s submission may be disqualified at the sole discretion of Sponsor.

6. Prizes: One (1) winner of this Sweepstakes ("Winner") will be randomly selected, as further described below, to receive the following prize: a trip for two to Ireland (includes airfare and hotel), with travel arrangements made by Bursch Travel, limited to $8,000 (total retail value of this prize is $8,000). The prize consists of only the items specifically listed as part of the prize. No cash equivalent or other prize substitution will be permitted except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value. The prize will be awarded and is non-transferable by the Winner. If a potential Winner is disqualified for any reason, Sponsor may award the applicable prize to an alternative Winner by random drawing from among all remaining eligible entries. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. Acceptance of a prize constitutes permission for Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

7. Odds of Winning: The odds of winning this Sweepstakes depends on the number of eligible entries received during the Entry Period.

8. Winner Selection and Notification: One (1) Winner of this Sweepstakes will be selected by a random drawing on or about March 28, 2024. The potential Winner will be notified within five (5) business days of the potential Winner’s selection by email, phone, or direct message from Sponsor’s official Instagram account. The potential Winner may be required to sign and return a completed affidavit of eligibility and release(s) via fax or email within 48 hours of prize notification, with the original documents sent to Sponsor via regular mail within seven (7) days of the date of prize notification. Non-compliance with these Official Rules, the inability of Sponsor to timely contact a potential Winner, a potential Winner’s failure to claim a prize within 10 business days from the time Sponsor sent the award notification, or a prize’s or prize notification’s return as undeliverable will result in such potential Winner’s disqualification and, at Sponsor’s discretion, Sponsor may award the applicable prize to a potential alternative Winner. Receipt of each prize offered in this Sweepstakes is conditioned upon compliance with all applicable federal, state, and local laws and regulations and these Official Rules. Allow up to eight (8) weeks from the date declared the Winner for delivery of a prize.

9. Rights Granted by the Entrant: By entering this Sweepstakes and submitting any content (e.g., photo, video, text, etc.), Participant understands and agrees that Sponsor and anyone or entity acting on behalf of Sponsor or its affiliates or its or their respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, Participant’s entry, name, portrait, picture, voice, likeness, image, statements about this Sweepstakes and/or Scotter’s Coffee, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this Sweepstakes, Participant represents and warrants that Participant’s entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If Participant’s entry infringes or is alleged to infringe upon the intellectual property right of another, Participant’s entry will be disqualified at the sole discretion of Sponsor. If the content of Participant’s entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, Participant shall, at Participant’s sole expense, defend or settle against such claims. Participant shall indemnify, defend, and hold harmless Sponsor and Sponsor’s affiliates from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor and Sponsor’s affiliates may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. By entering this Sweepstakes, Participant also agrees to be interviewed and photographed by Sponsor if Participant is randomly selected as a Winner of this Sweepstakes and Participant accepts such prize, and that Sponsor may announce on scooterscoffee.com and related websites owned and operated by Sponsor Participant’s full name, photo, likeness, and statements and publish a post with such items to all social media accounts including Facebook, Instagram, Twitter, and any other social media platforms, and any other forms of media.

10. Terms and Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Sweepstakes should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of this Sweepstakes. In such cases, Sponsor may select Winners from eligible entries received as of the date of such action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any Participant who violates these Official Rules or tampers or attempts to tamper with the entry process, the operation of this Sweepstakes, or any website. Sponsor has the right, in its sole discretion, to maintain the integrity of this Sweepstakes and to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses or multiple entries from the same computer in excess of that allowed by the Official Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

11. Limitation of Liability: By entering this Sweepstakes, Participant agrees to waive all right to, and to release and hold harmless Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from, any claim, liability, loss, damage and expense (including attorneys’ fees) that may arise out of or in connection with participation in this Sweepstakes or the acceptance, possession, use, or misuse of any prize or any portion thereof, whether caused by negligence or not. In no event will Sponsor and its affiliates, and its and their respective advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors, be responsible for: (i) lost, late, incomplete, or incorrect entries; (ii) a Participant's failure to receive prize notices due to the Participant’s spam, junk e-mail, or other security settings or the Participant’s provision of incorrect or otherwise non-functioning contact information; (iii) unauthorized human intervention in any part of this Sweepstakes; (iv) electronic or human error which may occur in the administration of this Sweepstakes or the processing of entries in this Sweepstakes; (v) technical, hardware, or software errors or malfunctions of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; (vi) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vii) any typographical, technological, printing, or other error in the offer or administration of this Sweepstakes or announcement of its prizes; or (viii) lost, late, postage due, misdirected, or undeliverable mail.

12. Choice of Law and Forum: Participant agrees that all matters arising out of or relating to this Sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of the state of Nebraska, without giving effect to any of its conflict of laws principles. Participant further agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes and these Official Rules, shall be resolved individually, without resort to any form of class action, and exclusively before any applicable federal or state court located in Omaha, Douglas County, Nebraska. Further, in any such dispute, under no circumstances shall Participant be permitted to obtain awards for, and Participant hereby waives all rights to, punitive, incidental, or consequential damages, including without limitation attorney’s fees, other than actual out-of-pocket expenses (i.e., any costs associated with entering this Sweepstakes), to the extent permitted by law. Participant further waives all rights to have damages multiplied or increased.

13. Winners List: To request a copy of the Winners list, available after March 28, 2024, please send a self-addressed, stamped envelope to: Scooter's Coffee – Luck of the Leprechaun Sweepstakes, 11808 Miracle Hills Dr., Ste. 400, Omaha, NE 68154. Requests must be sent within four (4) weeks of the end of the Entry Period.

14. No Sponsorship/Endorsement: This Sweepstakes is in no way sponsored, endorsed, or administered by or associated with Facebook, Twitter, Instagram, or any other social networks that are used to share this Sweepstakes, and Participant completely releases Facebook, Twitter, Instagram, and any such other social networks from any and all claims related to or arising from this Sweepstakes. Participant understands that Participant is providing Participant’s information to Sponsor of this Sweepstakes and not to Facebook, Twitter, Instagram, or any other social network.

15. Acceptance of Rules: By participating in this Sweepstakes, Participant acknowledges and agrees that Participant has affirmatively reviewed, accepted, and agreed to all of the Official Rules.
